Department of Correctional Services to appeal supreme court judgment on Zuma medical parole

THE Department of Correctional Services says it will file leave to appeal the judgment handed down by the Supreme Court of Appeal (SCA) in Bloemfontein on the medical parole placement of former President Jacob Zuma.

“Having carefully studied the judgment, Correctional Services is concerned that another court may arrive at a different conlusion,” said the Department of Correctional Services in a statement.

“DCS is consdering this course on the basis of the interpretation and applicaton of the Correctional Services Act and other relevant prescripts.”

On Monday, the SCA found that the medical parole granted to Zuma by then prison boss Arthur Fraser was unlawful and ruled he return to jail.

Zuma was sentenced to 15 months’ imprisonment by the Constitutional Court for contempt after he breached its order to obey the summons of the state capture commission.

After serving less than two months, he was granted medical parole by Fraser, the former national commissioner of correctional services, despite not being recommended for it by the medical parole board.

The SCA found that “Mr Zuma, in law, has not finished serving his sentence”.

“He must return to the Estcourt Correctional Centre to do so.”
