THE Constitutional Court has given the ruling party five days to hand over all records relating to its cadre deployment committee to the opposition party, the DA.
The country’s apex court on Monday ruled that all records, going back to January 2013, when President Cyril Ramaphosa became chairman of the cadre deployment committee encompassing meeting minutes, CVs, emails, Whatsapp messages and other relevant documents.
This ruling comes after the ANC lost its appeals in both the Gauteng High Court as well as the Supreme Court of Appeal.
DA MP Leon Schreiber said these records would show the party and President Cyril Ramaphosa’s complicity in state capture.
“It will help us complete the picture of how state capture took place, who was involved, and who should be held accountable.”
The DA said that it believes cadre deployment is the root cause of the collapse of state capacity, and the electricity and water crises.
“It (cadre deployment) enables the ANC to appoint people on the basis of loyalty to the party, rather than on the basis of merit and skill,” Schreiber said.
In its judgment on Monday, the Constitutional Court said it was refusing the ANC leave to appeal because it was not in the interest of justice to hear the matter.
ANC spokesperson Mahlengi Bhengu-Motsiri said the party noted the judgement of the Con Court on cadre deployment which is a practice not exclusive to the ANC both in South Africa and abroad.
Bhengu-Motsiri said the party would study the judgement to ensure that it is adhered to accordingly.
The DA also has a case in the Gauteng High Court to have cadre deployment declared unconstitutional and unlawful.
