ANC Security Blocks Sheriff from Attaching Luthuli House assets

ANC security personnel at its Joburg headquarters have refused entry to the Sheriff of the court who tried to move in to attach assets in a bid to recover the R102 million owed to Ezulwini Investment.

Among the goods to be seized was office furniture such as filing cabinets, boardroom tables and chairs, computers and a Ford Ranger, but problems started when the Sheriff arrived at Luthuli House. 

A security guard who witnessed the incident said the truck arrived early on Monday morning and said he saw the Sheriff going inside the building but after a while, he came out empty-handed.

Peter Fernando of Ezulwini said that a writ of execution was served on the ANC, and that the Sheriff had subsequently attached the party’s bank accounts and assets.

“We can see that they don’t want to pay, they don’t respect the judgement given by the High Court. They are undermining the justice system and we are disappointed that the ruling party is behaving in that manner. We see they want to prolong this,” Fernando said.

The company approached the court to recoup its money after the ANC failed to keep its agreement to pay for the procurement and installation of 30 000 PVC banners and to take them down as part of the party’s last push strategy before the 2019 General Elections.

Ezulwini charged R2900 for each banner, and an additional R70 to take each one down.

The ANC appealed the ruling but lost and the Supreme Court ordered it to pay the money owed to Ezulwini Investments with interest.

ANC spokesperson Mahlengi Bhengu-Motsiri said the Sheriff’s move to Luthuli House was illegal as the party had an agreement to hold off the liquidation order until their matter was heard in the Constitutional Court.
