Public Protector’s Report On The Financial Services Board Set Aside

THE Pretoria High Court has set aside Public Protector Busisiwe Mkhwebane’s report on the Financial Services Board. Mkhwebane’s report was declared constitutionally invalid and unlawful.

She has also been ordered to pay costs.

Last year, the Financial Sector Conduct Authority  (FSCA) filed papers requesting the court to review and set aside the report by the Public Protector in which she made findings of impropriety and maladministration against the Financial Services Board (now FSCA) and its Executive Officer, Advcoate Dube Tshidi.

In a 96-page report, Mkhwebane supported a complaint brought by the EFF, accusing the FSB officials, including Tshidi, for a wide variety of failures over a decade.

Meanwhile, a panel looking into whether Mkhwebane should be investigated by Parliament, is expected to begin work in November.

The three-member panel will decide whether the investigation into Mkhwebane’s fitness to hold office should continue.
