Mbalula: Ace Magashule found guilty, faces expulsion from ANC

Secretary-General Fikile Mbalula has confirmed that the African National Congress (ANC) disciplinary committee has found Ace Magashule guilty of contravening the party’s constitution.

Mbalula said that a detailed statement regarding the outcome of the disciplinary hearing will be released to the media.

Magashule’s misconduct primarily stems from his refusal to apologize to ANC President Cyril Ramaphosa and party structures.

Additionally, Magashule was found guilty of unilaterally suspending Ramaphosa in 2021 without consulting the relevant officials, such as the National Working Committee and National Executive Committee (NEC).

The ANC has been striving to uphold its internal discipline and address allegations of misconduct and corruption within its ranks.

The guilty verdict against Magashule reflects the party’s commitment to maintaining order and unity.

Expelling Magashule from the ANC would serve as a strong message that such actions are not tolerated and that all members are expected to adhere to the party’s constitution.

“Magashule has seven days to justify why he should not be expelled,” Mbalula said.

“The charge number is afforded seven calendar days from the date of being informed on becoming aware of this finding, to make written submissions to the NDC [National Disciplinary Committee].”

In May 2021, following a decision by the party, Magashule, the Secretary-General of the African National Congress, was suspended. 

This decision was part of the ANC’s policy to suspend members facing serious criminal charges if they refuse to step aside.

As a result, Magashule was effectively barred from participating in party activities for the duration of his corruption trial.

During his suspension, Magashule was prohibited from carrying out his duties as Secretary-General, including making public announcements or mobilizing party members. 
He was also not allowed to represent the ANC until the final outcome of his court proceedings.

To handle his responsibilities during this time, the late Deputy Secretary-General Jessie Duarte assumed the role.

However, Magashule further complicated matters when he announced his own decision to suspend President Cyril Ramaphosa.

In his announcement, Magashule claimed to be acting within his powers as Secretary-General and in accordance with relevant conference resolutions. This move triggered a hybrid disciplinary process, with ANC veteran Matthews Phosa representing Magashule.
