Madlanga orders disclosure of Khan’s medical condition, rejects postponement bid

The Madlanga Commission of Inquiry has ruled that suspended Crime Intelligence deputy head Major-General Feroz Khan cannot use medical confidentiality to shield the condition he relies on to avoid testifying.

Commission chairperson Justice Mbuyiseli Madlanga ruled on Tuesday that Khan’s general medical condition must be disclosed, while details of his condition and treatment would remain confidential.

“General Khan’s condition must be disclosed, but what must not be disclosed are the details concerning that condition,” Madlanga said.

In his formal ruling, Madlanga postponed Khan’s testimony to 28 September, when the suspended Crime Intelligence deputy head will be required to appear and testify in person unless an independent medical assessment confirms that he is unable to do so.

Khan must agree with the commission’s evidence leaders on an independent medical specialist by next Tuesday, failing which the specialist will be nominated by the chairperson of the South African Society
