The state intends to add a statutory rape charge against Limpopo musician Nkgodisheng Paul Madubanya, known as Tsaka RSA, the Polokwane Magistrate’s Court was told on Monday.
Madubanya, 29, was appearing for a formal bail application, but the hearing was postponed to Wednesday to allow his defence to respond to the new allegations.
Prosecutor Mangope Digoro told the court that the state intended to add charges of statutory rape and failure to store a firearm in a prescribed safe.
The charges would be added to the existing counts of unlawful possession of a firearm and ammunition.
The alleged sexual offence took place in June in Limpopo’s Capricorn District.
Madubanya was arrested on 9 October after police received information that he allegedly possessed an unlicensed firearm.
According to the National Prosecuting Authority (NPA), police searched his residence in Rethabile Gardens, Polokwane, where they allegedly found a firearm and ammunition.
During Monday’s proceedings, the state opposed bail and classified the matter as a Schedule 5 offence.
The defence challenged the classification, saying that no ballistic report had been provided to establish the status of the firearm allegedly recovered.
Madubanya’s legal representative requested a postponement to consider the additional allegations and prepare the defence’s bail application.
Madubanya remains in custody.
He also faces a separate crimen injuria charge in the Lebowakgomo Magistrate’s Court over allegedly offensive remarks posted on social media.
