Nkosi to remain in custody as bail bid is postponed

Suspended SAPS Gauteng Organised Crime Sergeant Fannie Nkosi will remain behind bars until next week after the Pretoria Magistrate’s Court on Tuesday postponed his bail application to 13 April.

Magistrate Renee Venter ruled that the state requires additional time to verify key information before bail can be considered, effectively keeping Nkosi in custody for at least another week.

Nkosi is facing charges of theft, defeating the ends of justice, and unlawful possession of unlicensed firearms and ammunition.

His arrest last Thursday followed a police raid on his Pretoria North home, where authorities seized firearms, nearly 500 rounds of ammunition, several case dockets and a hand grenade.

Prosecutors told the court that investigations are ongoing and that further verification is needed regarding Nkosi’s personal circumstances, as well as the items recovered during the raid.

This includes determining whether he was authorised to possess copies of police dockets from multiple stations, some reportedly linked to investigations as far as Musina.

The state also indicated that explosives found at Nkosi’s residence, including the grenade, would be subjected to testing later this week as part of the investigation.

Nkosi’s legal representative, advocate Sizo Dlali, opposed the postponement, accusing the state of abusing court processes and arguing that his client should not be kept in custody unnecessarily.

He said Nkosi was already at a disadvantage because of the public nature of the case.

Dlali further argued that the documents found at Nkosi’s home were copies, not originals, and that, as a police officer working on national investigations, it was not unusual for him to be in possession of such material.

He also raised concerns about the legality of the search warrant used during the raid, telling the court that the defence intends to challenge its validity.

Dlali pointed to inconsistencies in the warrant, including references suggesting the investigation began in 2025 and the involvement of officers linked to multiple task teams.

In a further submission, the defence claimed Nkosi had not eaten for six days since his arrest, citing concerns about the safety of food provided in custody.

The state, however, maintained that it needed time to properly assess the bail application, including verifying information related to Nkosi’s residence and employment, before proceeding.

The case is linked to allegations emerging from the Madlanga Commission of Inquiry, which is probing alleged links between police officials and criminal syndicates.

Prosecutors said Nkosi was arrested by a task team established following evidence presented at the commission.

Meanwhile, Magistrate Venter also ruled against a media application to broadcast proceedings live, stating that the request had been submitted too late and did not comply with standard court procedures.

She emphasised that future applications must be made in advance and should cover the entirety of pre-trial proceedings.

Venter acknowledged the public interest in the case but stressed the importance of balancing this with the rights of the accused.

Nkosi’s legal team has indicated it may consider its position on future media applications.

In a separate request, the defence asked that Nkosi be held at a police station rather than at the Kgosi Mampuru II correctional facility’s hospital wing, citing concerns for his wellbeing.

Venter ruled that he would remain at Kgosi Mampuru II for safety reasons.
