Controversial businessman and “political fixer” Brown Mogotsi will remain behind bars after the Johannesburg Magistrate’s Court dismissed his second bid for bail, finding that the evidence presented by his legal team did not amount to “new facts” as required by law.

In a ruling delivered on Monday, Magistrate Annalise Tlhabi concluded that Mogotsi’s renewed application merely repackaged information that had already been considered during his unsuccessful first bail application.

“The court has considered the evidence in the initial bail application together with the new facts which are placed before me and have found that there are no new facts but a reshuffling of evidence. My decision still stands. Bail is denied,” she said.
