Tribunal sets aside R25.9m Ngaka Modiri Molema wastewater contract

The Special Tribunal has reviewed and set aside a R25.9 million wastewater treatment contract awarded to the company Rensh CC after finding that Ngaka Modiri Molema District Municipality unlawfully abandoned a procurement process and used an emergency deviation to appoint a company that had not submitted a bid.

In a judgment delivered on 31 March 2026, which the Special Investigating Unit (SIU) released this week, the tribunal declared the contract between the municipality and Rensh constitutionally invalid and null and void from the outset.

The matter concerned repair and maintenance work at five Ditsobotla sites, including pump stations and wastewater treatment works. The judgment shows that the municipality had published a tender on 27 November 2019 and that five service providers submitted bills of quantities in December 2019.

Rensh was not one of those bidders. Instead, the judgment states, municipal technical director Mohamed Jafer Rasool telephonically contacted Rensh
